The Act allows an "eligible individual" to conceal their convictions in certain circumstances. An "Eligible individual" is defined in the Act as an individual who is eligible to have the clean slate scheme apply to them under the Act. Generally, under the scheme, if a person has been convicted of a minor offence, has not re-offended within 7 years, and has paid any fines or costs in full, they are an "eligible individual" and are deemed to have no criminal record for the purposes of any questions asked about their criminal record.

  • Have not been sentenced to a custodial sentence (this includes a community-based sentence)
  • Have not been ordered to be detained in a hospital due to their mental condition (instead of being sentenced)
  • Have paid in full any fines, reparation, costs or compensation ordered by the Court
  • Have not been disqualified from driving indefinitely
