Output Class Service Performance

Output Class D5 Enforcement of Fisheries Policies

Description

Under this output class the Minister of Fisheries purchases services and processes that promote compliance with fisheries laws and lead to detection of those involved in illegal fisheries activities.

Objectives

The objectives of this output class are to:

  • achieve the highest level of voluntary compliance with fisheries laws; and
  • deter non-compliance.

Scope

The outputs in the Enforcement output class are:

  • Commercial
  • Customary Maori
  • Recreational
  • International
  • Poaching and blackmarket
  • Compliance education and information services.

Achievements during the year

As part of the aim to deter non-compliance with fisheries laws and policies, each of the nine compliance districts maintains ongoing compliance monitoring programmes. These programmes, which were established by the target date of 30 September 2000, cover all aspects of compliance activity, from commercial enforcement through to poaching and blackmarket.

Commercial

Aside from the ongoing monitoring programmes, each district will also undertake specific operations where illegal fishing activity has been detected. During 2000/2001, 30 commercial operations were completed and several of these will result in prosecutions being taken. In other cases of more minor offending, written warnings have been issued. These operations were conducted in accordance with the compliance business policies and the provisions of the Fisheries Officers Manual.

Monitoring of commercial activity requires Licensed Fish Receivers (LFRs) to submit returns showing the landed catch from vessels. MFish analyses these returns against other fisheries returns. The target date required 80% of the returns to be received from LFRs and analysed by 31 December 2000. Although this target rate was not initially met, during 2000/2001 all fishing returns related to 1999/2000 fishing activity were reviewed and follow up action taken where appropriate.

Customary Maori

Information and education is provided to iwi and hapu on an on-going basis and forms part of the overall customary fisheries compliance programme. Programmes for all districts were developed by 30 June 2001. The focus of these plans is to raise voluntary compliance and assist iwi in the implementation of their customary management initiatives. One compliance operation was also completed.

Recreational

The requirement to comply with fisheries laws and policies applies equally to recreational fishers and monitoring programmes have been developed and implemented for this purpose. During 2000/2001, 15 compliance operations were completed in accordance with the provisions of the Fisheries Officers Manual.

International

As noted earlier in this report, New Zealand is signatory to a number of international fishing agreements. A monitoring programme has been developed to ensure that vessels fishing under those agreements do so in compliance with the requirements. Poaching and blackmarket Operational compliance programmes for all districts have been developed and implemented. Against a target of 20, the Ministry completed 21 operations, primarily in the paua, rock lobster and inshore finfish fisheries in accordance with the provisions of the Fisheries Officers Manual. Prosecutions will follow.

Education and information services

Information has been provided to stakeholders to inform them about fisheries obligations in a way which is easy to comprehend and 100% accurate. Nine recreational fisheries educational programmes have been implemented during the year.

Output Class D6 Prosecution of Offences

Under this output class the Minister of Fisheries purchases services relating to the prosecution of offences detected against fisheries laws.

Objectives

The objectives of this output class are to:

  • achieve the highest level of voluntary compliance with fisheries laws; and

  • effectively deter non-compliance via prosecutions

Scope

Case management is the sole output within this output class.

Achievements during the year

Case Management

All cases were initiated within the statutory timeframes (target 100%).
No cases were dismissed due to a lack of prima facie evidence (the target requires that less than 5% are dismissed). There was a 94.5% success rate for cases prosecuted under the Fisheries Act (the target is a 90% success rate).
There was a 95% success rate for cases brought under fisheries regulations (the target is a 60% success rate).
All evidence and forfeit property was maintained in secure conditions (target 100%). All forfeit property was disposed of in accordance with the Minister’s directions and within specified timeframes (target 100%).
