Output Class Service Performance
Output Class D3 Regulatory Management
Description
Under this class of outputs, the Minister of Fisheries purchases services to develop guidelines, regulations and processes, which make the fisheries policy framework operational.
Objectives
The objectives of this output class are to:
- provide advice to support sustainable fisheries
- assess special fisheries access requests
- provide support for international fisheries arrangements
- advise on legislative and government regulatory processes
- manage the cost recovery process.
Scope
The outputs in this output class are
- Sustainability and utilisation measures: The process of preparing advice papers and consulting with stakeholders on the proposed changes to sustainability measures and controls.
- Management of impacts of fishing: Providing the capacity in the Ministry of Fisheries to undertake projects aimed at avoiding, mitigating and remedying the impacts of fishing on protected and other species.
- Assessment of management proposals: Assessing specific fisheries management proposals under the fisheries legislation, including proposals to manage local customary fisheries, and proposals to implement dispute resolution outcomes.
- Supporting international arrangements: Representing New Zealand in the maintenance of international arrangements.
- Legislative implementation: Guidelines and regulations to operationalise amendments to the Fisheries Act 1996.

Achievements during the year
Sustainability and Utilisation Measures
In this activity, the Ministry utilises the information provided through the fisheries research projects to assist it in developing the advice papers to the Minister of Fisheries on sustainability measures required for the forthcoming fishing year. The Ministry’s work culminates in two specific advice papers, one for the October fishing year and the other for the fisheries with an April season (eg rock lobster). These papers seek the Minister’s approval for setting the total allowable catch and total allowable commercial catch for the relevant fishing years.
1 October 2000 measures
The final advice paper on the review of sustainability measures for the fishing year commencing 1 October 2000 was provided to the Minister on 11 August 2000, against an originally planned date of 30 August. This paper gave stakeholder views and MFish advice and recommendations on all proposals and issues consulted on in the 2000 Review of Sustainability Measures.
MFish consulted with stakeholders on proposed regulatory amendments during
the sustainability measures and management controls process. Cabinet approved the
following Notices:
- The Fisheries (Total Allowable Catches) Notice 2000;
- The Fisheries (Quota Management Areas, Total Allowable Catches and Catch
Histories) Amendment Notice 2000;
- The Fisheries (Conversion Factors) Notice 2000;
- The Fisheries (Pilchards Commercial Catch Limit) Notice 2000;
- The Fisheries (South East Area Amateur Fishing) Amendment Regulations 2000;
- The Fisheries (Challenger Area Amateur Fishing) Amendment Regulations 2000;
- The Fisheries (Commercial Fishing) Amendment Regulations (No.2) 2000;
- The Fisheries (Amateur Fishing) Regulations (No.2) 2000.
The regulations were Gazetted on 16 November 2000, against an originally planned date of 30 September 2000. In addition the Ministry prepared an extensive report on the management of orange roughy stocks in areas 2A, 2B, 3A and 7A over the last five years. An independent report on that report concluded that the Ministry’s management of the stocks has generally been effective.
1 April 2001 measures The final advice paper on rock lobster sustainability measures and management controls was submitted to the Minister on 28 February 2001 (the originally planned date was 1 March 2001). The Minister’s final decision letter was sent to stakeholders on 22 March 2001. The following amendments were adopted for the season commencing on 1 April 2000:
- The Fisheries (Amateur Fishing) Amendment Regulations 2001;
- The Fisheries (Southland and Sub-Antarctic Areas Amateur Fishing) Amendment
Regulations 2001;
- The Fisheries (Southland and Sub-Antarctic Commercial Fishing) Amendment
Regulations (No. 2) 2001;
- The Fisheries (Southern Bluefin Tuna Quota) Amendment Regulations 2001;
- The Fisheries (Recordkeeping) Amendment Regulations 2001;
- The Fisheries (Reporting) Amendment Regulations 2001;
- The Freshwater Fish Farm Amendment Regulations 2001;
- The Fisheries (Commercial Fishing) Amendment Regulations (No. 2) 2001;
- The Fisheries (Central Area Commercial Fishing) Amendment Regulations (No. 2) 2001;
- The Fisheries (Auckland and Kermadec Areas Commercial Fishing) Amendment

Changes to Total Allowable Catches (TACs) and Total Allowable Commercial Catches (TACCs) for CRA7 and CRA8 were gazetted on 29 March 2001 against a target date of 1 March 2001.
2000/2001 Fishing year
Proposals from stakeholders for stocks to be included in the 2001 Sustainability Review were received by 26 January 2001. Proposals were assessed against a
set of criteria determined by the Ministry and confirmed by the Minister. Initial Position
Papers were developed for management proposals for the fishing year commencing 1 October 2001, and stakeholder consultation on these proposals was initiated on 15 June 2001.
TAC and TACC changes for the SBW6I fishery were gazetted on 29 March 2001. Legislation was enacted on 29 June 2000 to allow the introduction of the South Island eel fishery into the Quota Management System (QMS). Quota was allocated and South Island eels introduced into the QMS by the target date of 1 October 2000.
An initial list of species proposed for inclusion in the QMS on 1 October 2002 has been determined and work initiated on stock allocation and cost benefit analysis for those species. The planned date of 30 June 2001 was not met because of decisions to include an increased number of species in the QMS from 1 October 2002.
Management of Impacts of Fishing
One of the aims of fisheries management is to avoid, mitigate and remedy the impacts of fishing on protected and other species. This output is about providing capacity within the Ministry of Fisheries to undertake projects and review regulations with the objective of achieving this aim.
The plan for measures to mitigate the incidental catch of Hectors’ dolphin in the Banks Peninsula set net fishery for the 2000/2001 summer was required to be completed by 1 October 2000. Discussions took place between local fishers and the local MFish office and the final measures were agreed in November 2000. Proposals for long-term measures for mitigating the incidental catch of Hectors’ dolphin in the Banks Peninsula set net fishery have been developed and consultation with stakeholders is underway.
Advice was also provided to the Minister on options to manage the adverse effects of fishing on North Island Hectors’ dolphins. After undertaking public consultation on these options, a final advice paper was provided to the Minister.
Following concern about the effects of trawling on the benthic habitats and aquatic life found on seamounts, approval was given in April 2001 to close 19 seamounts to trawl fishing (this was outside the original plan for the advice to be provided by 1 October 2000). The objective behind the closure is to implement a strategy to manage the adverse effects of fishing on seamounts. The specific areas closed were in Fisheries Management Areas 1, 2, 3, 4, 5, 6 and 9. The regulatory changes necessary to put the approval into effect were gazetted on 12 April 2001.
The deadline of 1 October 2000 to provide the Minister with a draft National Plan of Action (NPOA) relating to the incidental capture of seabirds in fishing operations was met, with the advice provided in June 2000 and released to stakeholders in July. The deadline for submissions was extended to 1 October 2000 following stakeholder requests. Consideration of submissions, consultation with stakeholder groups, and revision of the draft NPOA has been undertaken by a joint stakeholder/officials committee. A revised plan will be circulated to stakeholders for consideration early in the 2001/02 financial year. It is intended that the final plan will be submitted to Ministers for approval by December 2001.
Following consultation with stakeholders, the Minister of Fisheries approved an operational plan for the management of the squid fishery interaction with sealions in October 2000 and by the Minister of Conservation in December 2000. The target date for approval was 1 December 2000.
Assessment of Management Proposals
This output relates to the assessment of proposals for specific fisheries purposes under the Fisheries legislation.
No new fisheries proposals arose during the year. Advice was provided to the Minister on the outcome of fisheries dispute in the eastern Bay of Plenty, which had arisen in 1999/ 2000. Work related to the resolution of the Tauranga harbour dispute was also undertaken.
Supporting International Arrangements
New Zealand is party to various international agreements relating to fishing and fishing interests. This output is about the activities required to maintain those agreements.
The US/Pacific States Convention on the Conservation and Management of Highly Migratory Fish Stocks in the Western and Central Pacific (named the Western and Central Pacific Fisheries Commission (WCPFC) was concluded in Honolulu in September 2000. In April 2001, New Zealand hosted the first preparatory conference under the Convention, the focus of which was on the establishment of the new Commission. The preparatory conference began the work of developing implementation processes. CCSBT – New Zealand chaired the April meeting in Sydney. Progress was made to resolve issues of dispute in relation to Japan’s unilateral experimental fishing programme. Progress was also made on the inclusion of other fishing entities in the Convention.
CCAMLR – A joint MFAT/MFISH briefing paper has been submitted to Cabinet. This paper summarises fishing activity for 2000/01 and proposes options for future fishing by New Zealand vessels. A Fisheries management plan is being prepared for submission to CCAMLR meetings in October/November 2001. MFish was involved in the scientific committee meeting in Tokyo in March 2001 to recommend options for negotiating positions at the October/November 2001 meetings.
Although three licences were issued for fishing orange roughy on the South Tasman Rise, by 30 June 2001 no fishing by any New Zealand vessels had occurred. It is intended that the TAC for STR orange roughy will be reviewed in October 2001. New Zealand’s negotiating positions have at all times been approved by the Minister prior to negotiations taking place..
Legislative and regulatory processes
This output relates to the provision of input into the statutory processes managed by other government or regional agencies which could impact on fisheries matters within the Ministry’s range of responsibilities.
The Ministry is continuing its consultation with stakeholders on the development of the framework for fisheries plans. There are pilot plans being developed for oreo and orange roughy fisheries PAU5B, BCO7, and the Kaipara harbour. The Ministry has provided technical advice to stakeholders for the development of these plans. The plans were not ready for review by 31 December 2000.
Liaison is progressing with DoC on the development of advice to the Minister of Conservation on the Wellington South Coast marine reserve application. This issue is likely to take more than the 40 working days target time to resolve. The Ministry has also provided input into Crown submissions for the High Court review of the Minister’s concurrence for the Gisborne marine reserve application.
MFish has also:
- Made submissions on coastal planning matters under consideration by Canterbury and Southland Regional Councils.
- Provided input into Crown submissions to the Environment Court hearing into the aquaculture references in the Tasman District Council’s Proposed Resource Management Plan.
- Jointly made a presentation with the Auckland Regional Council to the Hauraki Gulf forum on shellfish management and scope of a combined harvesting and environmental effects project.
- Analysed a Ports of Auckland proposal to deepen a shipping channel.
Customary Maori Fisheries
MFish has continued to receive quarterly reports from Ngai Tahu on customary harvesting data. This has been incorporated into the MFish catch effort database and provides useful input to the advice on sustainability measures. The Ministry has provided advice to the Minister on closures to shellfish harvesting in the Firth of Thames, and at Eastern Beach under section 186A of the Fisheries Act 1996.
The appointment of kaitiaki is proceeding slowly. At the end of June 2001, there had been 24 kaitiaki appointments and 10 kaitiaki cancellations in the South Island. In the North Island, the Ministry had provided advice to the Minister on the appointment of two kaitiaki for Maruhaeremuri and a further kaitiaki appointment for Aotea Harbour. Ten kaitiaki have already been appointed for the harbour.
No other appointments were made in the year. The estimated number of appoint-ments for the year was 120. The renewal of the Agreement for Services with Ngai Tahu was completed.
In addition, MFish has presented advice to the Minister on:
- a taiapure proposal for Kawhia-Aotea harbours;
- the appointment of the Taiapure Management Committee for East Otago;
- an application for taiapure in Delaware Bay.
Ma-taitai
Advice was provided to the Minister on establishing Koukourarata ma-taitai. Public consultation on applications for ma-taitai at Waitutu and Moeraki were also carried out. A proposal for a ma-taitai off the Napier coast has been discussed with the applicant. Additionally, the first application for ma-taitai by-laws has been received.
Setting Standards and Specifications
This output is about developing fisheries management service standards and specifications for those fisheries management services that will be
contracted. It also includes monitoring and auditing the external service providers’ performance against these standards and specifications.
By 30 June 2001, the Ministry was required to have processes and systems in place that improve the quality, integrity and access to catch and effort information, and data entry, and validation of catch effort information operating under a specifications and standards based regime.
This has been achieved with the level of quality from catch effort data defined, at a detailed level, and published as the “Catch Effort Data Quality Specifications and Standards”. The computer system has been altered to incorporate most of the checks required to achieve the appropriate level of data quality and data quality has been improved as a direct consequence. A reporting tool, together with reports to provide access to catch effort information has also been developed (with final testing and report development currently underway). Work has been completed to improve the integrity of catch effort information by documenting issues that affect the interpretation of catch effort information through time. Work has also been conducted towards upgrading of historical catch effort data.
Eleven of the 14 data quality checking modules have been completed and are in operation. The remaining three modules will be in place by 1 October 2001 for the start of the new fishing year. The report tool (and associated reports) was released within the Ministry in early August 2001.
Significant progress has been made towards operating, data entry and validation under the new specifications and standards based regime, including:
- development and release of specifications and standards for public comment;
- significant computer system development by the Ministry’s Information Technology and Communications Group to implement the new required rules and the necessary monitoring systems (most of this is now in place);
- gradual implementation of the new rules on a monthly cycle so that validation is moving to the new regime on a gradual basis rather than an overnight changeover (most of this is now in place).
This regime will be formally implemented through a contract on 1 October 2001 for the start of the new fishing year.
The contract for upgrading research data was signed on 26 October 2000, well within the deadline of 30 November 2000.
The annual review of the research database standards and specifications was completed, as required, during May 2001. A number of minor changes were made to the standards as part of the review.
Commercial Fisheries Services Ltd (FishServe) provides catch effort data entry and validation under a contract negotiated with MFish. The Ministry undertakes monthly monitoring of this work as part of the contractual provisions. Research data and research data management services are provided by the National Institute for Water and Atmospheric Research (NIWA). Evaluation of reports submitted by the contractor (NIWA) was conducted on an ongoing basis throughout the year according to requirements.
The requirement in the Departmental Forecast Report for an audit by 30 June 2001, of the external research data manager was completed within the timeframe. An audit was conducted during June on the contents of one of the main databases being managed by NIWA. The audit found a number of problems in the management of the data that needed to be addressed, but overall, the standard of the data was high. A draft consultation document on the framework for the direct purchase of fisheries research services was completed on 29 September 2000. The Minister of Fisheries has determined that he will only consider direct purchase following the development and implementation of fisheries plans, with a fisheries plan being the prerequisite for direct purchase.
No further work will be carried out against this output until such time as fisheries plans that recommend direct purchase are initiated.
Education and Information Services
This output covers the management of enquiries and information relating to New Zealand fisheries. Material has been provided on an as requested basis.
Cost Recovery
The revised levies for the 2000/2001 year were approved on 18 September 2000 and came into effect from 1 October 2000. The Gazette Notice was issued on 22 September 2000. This was outside the originally planned timeframe of 1 September. The Ministry held its Business Plan plenary meetings in Wellington on 31 March and in Auckland on 3 April. Final decisions on services to be provided in 2001/2002 were made by the Minister of Fisheries on 26 June.
Preliminary work was undertaken on the cost recovery model, as part of the process for determining the cost recovery levies for 2001/02.

Output Class D4 Fisheries Access and Administration
Description
Under this class of outputs the Minister of Fisheries purchases services associated with fisheries access including the:
- issue of fishing permits and licences
- management of registry and recording systems.
Objectives
The objectives of this output class are to:
- issue permits, licences and leases for access to New Zealand's fisheries
- maintain the quota register
- manage the statutory reporting functions associated with approved access to fisheries
- implement the devolution of registry based and related services
- manage the Ministry 0800 information service
Scope
The outputs in this output class are
- Management of access for fishing activities: Management of the processes relating to the granting of fisheries access rights.
- Management of commercial property rights: Management of the fisheries property rights information bases.
- Devolution of services: Implementing the devolution of non-core government services
- Delivery of registry services: Managing external contracts with registry delivery agencies.
- Education and information services: Management of enquiries and information relating to New Zealand’s fisheries.
Achievements for the year
Management of Access for Fishing Activities
Management of Access for Fishing Activities
This output concerns the management of the processes relating to granting of access to fisheries rights. There is a three day standard for the issue of fishing permits. Some permits were not issued within 3 days at the end of September due to the backlog which built up during the annual repermitting process. However, all applications which were received by the September date notified to fishers, were processed and permits were issued.
During the year:
- 66 special permit applications/variations were processed in accordance with the procedures set out in the Special Permit Manual
- 4 permit reviews were completed, 2 under s63 (11) of the Fisheries Act 1983 and 2 under s329 of the Fisheries Act 1996
- A total of 1,177 commercial permits were processed during the year, with 1,072 (91%) of these permissions being processed within the target 3 day timeframe
- An evaluation of section 64 permit variations for cockle fishing permits in FMA7 was commenced
- 258 aquaculture authorisations were completed during the year, including 73 new marine farm and spat catching permit applications in accordance with the relevant legislation or regulatory provisions
- 1,525 vessel registrations were issued with 107 (7.1%) outside the target 3 day period
- A total of 179 other authorisations were issued with 17 (9.5%) outside the 3 day period
- A total of 17 licensed fish receiver licences were issued. All were issued within stated performance standard of 15 working days.
The Ministry also maintained control over fisheries subject to competitive catch limits and closed the following fisheries on the specified dates:
- The Southern Bluefin Tuna (STN) Fishery on 4 July 2000 for the 1999-2000 fishing year, and 16 June 2001 for the 2000-2001 fishing year
- The SCI6B fishery on 20 September for the 1999-2000 fishing year
- The SCI3 fishery on 8 October 2000 for 2000-2001 fishing year
- The KAH2 fishery on 11 February 2001 for the 2000-2001 fishing year.
The catch limit was exceeded in both the STN and KAH fisheries. In addition, input and support was provided for the Crown defence in a judicial review action against the decision to decline an application for a marine farm permit in the Marlborough Sounds. Forfeiture action was initiated on derelict oyster farms at Waiheke Island. Advice was provided to the Minister in support of the Primary Production Select Committee enquiry into the use of grass carp in Lake Omapere.
Management of Commercial Property Rights
This output covers the management of the fisheries property rights information databases. During the year:
- A total of 9,115 quota trades were processed, with 250 completed outside the one day time limit. All trades were processed correctly and without error, in accordance with the standards required.
- The Ministry received a total of 205,372 statutory returns, from which data was required to be captured correctly. Not all data was initially captured correctly.
- 12,875 quota management returns were received, of which 99.73% were entered into the register in time to be included in the monthly balancing calculations. This was only slightly less that the 100% target.
- All monthly balance reports were issued within the required six week timeframes.
- Only seven (2.04%) of the 343 monthly balance reviews requested by fishers were as a result of delivery agency error. This was well within the Ministry standard of 15%.
Statutory bodies, such as the Fisheries Authority continue to be provided with the administrative support necessary for them to function effectively.
Devolution of services
The Minister of Fisheries has approved the services to be devolved and has granted contingent approval for the New Zealand Seafood Industry Council Ltd. (SeaFIC) to be appointed as the Approved Service Delivery Organisation (ASDO) to deliver those services. Formal transition plans were codified in a revised contract with SeaFIC, which was signed on 30 March 2001. A government decision formally approving the ASDO, together with an Order-in-Council gazetting that approval will be sought early in the 2001/2002 financial year.
The introduction of the balance of the Fisheries Act 1996, and the move towards delivery of the services through an ASDO, has required major changes: a new “quota management system” is being developed and policy definitions, guidelines, regulatory interventions and standards and specifications have to be developed to support the commencement of the new QMS established under the 1996 Act: standards and specifications for devolved services were issued by the Minister on 13 March 2001.
The Act prescribes formal processes to manage the transition of property rights from the 1983 Act to the 1996 Act. The Ministry has, as part of its overall registry delivery arrangements, contracted the Seafood Industry Council/Commercial Fisheries Services (SeaFIC/CFS) to deliver these services prior to 1 October 2001.
Major regulatory changes are also required and the Ministry is operating to a very strict timetable to gain the necessary approvals prior to 1 October 2001. Drafting instructions have been issued to Parliamentary Counsel Office for some of these regulations. Others will follow once the appropriate approvals have been given. The commencement of the balance of the Fisheries Act 1996 on 1 October 2001 will change the nature of some services and the method by which they are delivered. This new Act provides a revised management framework for the day-to-day operation of the Quota Management System (QMS) in respect of commercial fishing operations. The following table summarises the services being provided under the 1996 Act and the changes from the 1983 Act.

Delivery of registry services
This output deals with the management of external contracts with delivery agencies and its purpose is to ensure statutory compliance with the terms and conditions of the contracts and that any risk to the Crown is minimised.
The Ministry monitors these contracted services through a series of regular reporting processes designed to provide an assurance that the conditions for contracted services are being adhered to. During the year all service level agreement requirements were satisfied by the provider. The reporting processes also provide information for other parts of the Ministry’s operations and this information is transmitted to those areas as required.
The contracts also place requirements on the Ministry. During the course of the year, the Ministry met these obligations in full.
Education and Information Services
This activity covers the management and handling of Fisheries Services related enquiries and information. This includes the referral of callers to other business units within the Ministry for information relevant to them. All documents and reports were provided or published within specified deadlines after approval.
