1998/99 Financial Performance

Output Class D3: Government Service
Specification and Purchasing

In this output class the Minister for Food, Fibre, Biosecurity and Border Control purchases services covering the provision of advice on the level, standards and specifications to be applied to Ministry services which are able to be delivered on a contestable basis; management of the cost recovery regime; and contracting of contestable fisheries research services. The aims of this output class are:

  • to provide service standards and specifications
  • to identify those who, in accordance with the Fisheries Act, will participate in the consultative process
  • to manage the cost recovery process in an orderly and timely manner
  • to introduce and manage the contestability regime for fisheries research services on a sound commercial basis
  • to manage the resulting contracts
  • to ensure activities in this output class are carried out in a sound legal manner.


Performance requirements and achievements during the year

Contestable services

Provision of advice on standards and specifications for contestable services, including research and stock assessment.

A framework for draft research proposals for 1998/99 developed.

Framework developed and documented by 18 December 1998.

Ministry research priorities for 1999/2000 established.

Ministry research priorities for 1999/2000 agreed and documented by 18 December 1998.

Fisheries research standards and specifications for 1999/2000 reviewed.

Cost recovery

Approved parties identified and consulted on proposed fisheries services for the 1999/2000 year. Minister is advised of stakeholder and Ministry views on proposals and allocation of costs between the Crown and industry.

Cost recovery levies promulgated for the 1998/99 year.

Levies set in time for the commencement of the fishing year on 1 October 1998.

Paper detailing the proposed fisheries services for the 1999/2000 year.

Management of contracts

Includes the process of tendering contracts, their award to successful tenderers, establishment of standards and specifications for research data and the management of contracts to ensure contractors fully conform to the conditions of the contract and standards required.

All contracts for fisheries research services for the 1998/99 financial year to be finalised by 1 October 1998.

Contractual relationships were achieved by the execution of letters of award for 50 contracts for the 1998/99 year by the end of September 1998.

Other contracts were let as and when contract negotiations were finalised. The total number of contracts awarded for 1998/99 was 70.

All contracts awarded to service providers will:

  • include a statement of purpose
  • identify the parties to the contract
  • specify the term of the contract
  • provide for the disposition of risks
  • provide the best service for the best price
  • include a formal contract variation process
  • state the time, amount and method of payment
  • specify outputs and agreed measures of performance
  • provide for reporting arrangements
  • state how the results are to be assessed
  • provide for sanctions for non-performance
  • specify mechanisms for disputes resolution
  • be in accordance with New Zealand law.

Commercially sound, risk averse contracts were entered into which addressed all necessary issues.

All contracts will be completed with all deliverables delivered in accordance with the Conditions of Contract and to the complete satisfaction of the Ministry and the contractor.

All contracts were completed in accordance with the conditions of the contract. The Ministry has installed a new database (Ikabase) for contract auditing and monitoring. Contracts are being monitored using Ikabase and the existing monitoring system.

Scientific evaluation of final reports on contestable services will be completed to the agreed standards within 28 days of receipt of the report.

The scientific evaluation was completed on all projects, but there were instances when the evaluation was not completed within the specified 28 day time period.

Scientific audit of contestable research services will be completed to agreed standards and within the agreed timetable.

Tenders for research contracts for 1999/2000.

In the quarter ended December 1998, the tender documentation was rewritten and distributed to all tenderers.

In March 1999 tenders were received for the initial round of fisheries research projects.

By June 1999, the commercial evaluation of tenders received in the initial round for 1999/2000 had been completed.

In June, tenders were received for the second round of research projects for 1999/2000.

Output Class D4: Enforcement of Fisheries Policies

Under this class of outputs the Minister for Food, Fibre, Biosecurity and Border Control purchases services which support the sustainable utilisation of New Zealand's fisheries by promoting compliance with fisheries laws and detecting illegal activity. The aims of this output class are:

  • to achieve the highest levels of voluntary compliance with fisheries laws
  • to effectively deter non-compliance.

To achieve these aims, this output class detects offences against fisheries laws through the monitoring and surveillance of fishing and fish product flows, the inspection of vessels, licensed fish receivers and dealers in fish product, the collection and analysis of information and intelligence, the audit and investigative examination of business records and the investigation of illegal fishing activities.


Performance requirements and achievements during the year

Detection of Offences

This involves monitoring and surveillance of fishing and fish product flows, the inspection of vessels, licensed fish receivers and dealers in fish product, the collection and analysis of information and intelligence, the audit and investigative examination of business records and the investigation of illegal fishing activities.

Commercial

An estimated 47 enforcement operations to be completed.

47 operations carried out during the year.

100% of enforcement operations completed and reported in accordance with the Fisheries Officers' Manual.

100% of case files completed in accordance with the Fisheries Officers' Manual.

100% of the proportion of 3 total substantive audits carried out in accordance with the Chief Investigating Accountant's specifications.

Eight substantive audits were undertaken.

100% of vessels over 28 metres in length (whether NZ registered and foreign licensed or foreign chartered) monitored through the vessel monitoring system.

Fisheries compliance priority areas and requirements provided prior to each RNZAF flight for fisheries enforcement.

All RNZAF surveillance flights were briefed.

Poaching/Blackmarket

An estimated 25 enforcement operations completed and reported.

22 operations were undertaken in respect of poaching/blackmarket activity in shellfish.

A further nine operations were undertaken in respect of poaching/blackmarket activity in finfish.

100% of enforcement operations completed and reported in accordance with the Fisheries Officers' Manual.

The non-commercial output includes offence detection for Customary Maori fishing activity and recreational fishing activity.

Three enforcement operations were undertaken in the Customary Maori area and a further 15 in the recreational area.

100% of enforcement operations completed and reported in accordance with the Fisheries Officers' Manual.

Establish and maintain an Honorary Fisheries Officer (HFO) and Fishcare volunteer network.
