1998/99 Financial Performance

Output Class Service Performance
Output Class D1: Policy Advice

Description

Under this class of outputs the Minister for Food, Fibre, Biosecurity and Border Control purchases strategic policy advice and advice relating to international fisheries. The aims of this output class are:

Strategic policy advice

  • to monitor and improve the legislative and policy framework for the sustainable utilisation of fisheries resources

International fisheries

  • to advise on market access for New Zealand seafood via international regimes and agreements.


Achievements during the year

In accordance with the standards set for policy advice:

All papers clearly stated their aims and answered questions that had been set.

Assumptions were made explicit and arguments were logical and supported by facts.

Facts presented were as accurate and as complete as the Ministry could determine.

An adequate range of options, assessed for costs, benefits and consequences to fisheries management, was included in most papers.

Consultation was held with interested parties, where applicable, and summaries prepared of the views presented and objections put forward.

All papers considered each of the problems, where applicable.

All papers met the required standards.

96 per cent of first drafts of Ministerial correspondence were accepted by the Minister (standard required is 97 per cent).

82 per cent of first drafts of Ministerial correspondence were prepared within 15 days of receipt of the correspondence (standard required is 96 per cent).

All reports and verbal advice delivered within the agreed or statutory timeframe.

The Minister has provided comments on the quality of the service provided.

Specific policy advice was presented on the following issues:

Maori fisheries

Advice on issues arising from the Crown's Treaty obligations as expressed in fisheries legislation.

Provided advice to the Minister on the proposal from Te Ohu Kai Moana on the allocation of fisheries assets under the Treaty of Waitangi (Fisheries Claims) Settlement Act 1992.

Existing fisheries legislation

Monitor and provide advice on the performance of existing policy and legislation.

Policy advice provided to the Minister on the introduction into the Quota Management System of species currently listed on the fourth schedule of the Fisheries Act.

Input provided to the Department of Labour to clarify the exact nature of the existing minimum wage provisions within the Fisheries Act and their impact on foreign crew working on charter vessels in New Zealand.

Environmental monitoring

The development of a framework within which to monitor New Zealand's environmental performance against international standards.

Draft indicators for fisheries and for the marine environment distributed to stakeholders during February 1999. The Minister has approved the first set of environmental indicators for fisheries.

International fisheries policy

Contribute to the development and maintenance of international policies, conventions and agreements:

OECD

Contributed to OECD Fisheries Committee study on the link between financial transfers in the fisheries sector and sustainability.

Trans-Tasman fisheries

Passed regulations to put in place a temporary ban on fishing on the South Tasman Rise until a durable agreement is negotiated. Collaborated with Australia to ensure fishing by third parties on the South Tasman Rise was minimised.

CCSBT

Assisted in the development of a consensus on the experimental fishing programme (EFP). Provided advice to joint Ministers on Japan's intention to proceed with the unilateral EFP.

Output Class Service Performance
Output Class D1: Policy Advice

Under this class of outputs the Minister for Food, Fibre, Biosecurity and Border Control purchases operational advice relating to the ongoing management of fisheries. The aims of this output class are to:

  • provide advice to the Minister which will support sustainable utilisation of the fisheries
  • inform and educate stakeholders
  • provide Ministerial services.

Achievements during the year

Urgent letters were responded to within five days.

96 per cent of first drafts of Ministerial correspondence were accepted by the Minister (standard required is 97 per cent).

82 per cent of first drafts of Ministerial correspondence were prepared within 15 days of receipt of the correspondence (standard required is 96 per cent).

All reports and verbal advice delivered within the agreed or statutory timeframe.

The Minister has provided comments on the quality of the service provided.


Policy advice was presented on the following issues:

Sustainability measures

Provide advice on Total Allowable Catch limits and sustainability measures including estimating sustainable yields and stock status.

Final advice papers provided to the Minister on:

  • Rock lobster sustainability measures and management controls for 1999/2000.
  • The future management of pale ghost shark and Southern Blue Whiting. This included a summary of stakeholder submissions, advice on the introduction of these stocks into the QMS and legislation required to achieve introduction into the QMS.
  • The future management of cardinalfish.

Initial advice papers provided to the Minister on:

  • PAUA area 5B proposed sustainability measures and management controls for 1999/2000. Consulted with stakeholders concerning proposed sustainability measures.
  • The review of sustainability measures and other management controls for the 1999/2000 fishing year. Consulted with stakeholders.

Allocation of access

Special permit applications will be processed within 6 months of receipt.

70 special permits applications received.

Marine and freshwater aquaculture applications will be processed within 3 months of receipt.

126 marine and freshwater aquaculture applications received.

Freshwater transfer authorisations will be processed within 1 month of receipt.

74 freshwater authorisations processed.

Most of these applications were processed within the specified period, from a receipt of a completed application. "Completed" means that all required inputs had been received from the applicant and other agencies.

It should be noted that most of the above applications and authorisations involve a number of statutory steps that in turn require information, documents, etc from applicants; and comment, concurrence from various agencies. The Ministry of Fisheries has no control over the response time of other parties, and hence no control over the time taken to process applications or authorisations prior to the receipt of a fully completed application.

Customary Maori fisheries

Establishment of taiapure and ma-taitai

Provided advice to the Minister on reports from the Waitangi Tribunal in respect of applications for the establishment of taiapure at Kawhia and Manukau.

Undertook consultation with Kati Huirapa regarding formation of a management committee for the Karitane taiapure.

Treaty partnership

Consultation on the implementation of fisheries policies with Maori.

Options developed with iwi to provide for effective input and participation of tangata whenua into fisheries processes. Initial discussions on how to improve the Ministry's database of contacts for iwi, hapu-, marae and key individual tangata whenua.

Education and information dissemination

Education and information materials are widely disseminated.

Materials were distributed to a wide range of organisations, at several hui, and at meetings with stakeholders and the general public.

Eel management programme

Development of an eel management programmewith iwi and industry.

6 area management plans completed and presented to the Minister.
