OUTPUT 81 - AQUACULTURE SETTLEMENT IMPLEMENTED

EXPLANATION

The provisions in the Maori Commercial Aquaculture Claims Settlement Act 2004 are designed to settle all Maori claims to commercial marine farming post 21 September 1992, by providing iwi with an allocation of an area equivalent to 20% of the total space allocated since 1992 and 20% of new marine farming space. This will be met through the provision of new space, the purchase on a willing buyer/willing seller basis of existing space, or the provision of financial equivalent.

Establishment of process to quantify and monitor the settlement space

The Ministry has established a register of pre-commencement space as at 1 January 2005 and the outstanding pre-moratorium decisions. The register of pre-commencement space as at 1 January 2005 and the outstanding pre-moratorium decisions has been consulted on with regional councils to verify the data.

Establish the role of the trustee in relation to the settlement trust Achieved

Te Ohu Kai Moana Trustee Limited (TOKMTL) was established as the trustee under the Ma - ori Commercial Aquaculture Claims Settlement Act 2004. On 26 July 2005, the Minister of Fisheries and TOKMTL board signed the funding agreement to enable the trustee to operate within the terms of the agreement.

Communication of the settlement rights and obligations to iwi, regional councils and commercial aquaculture stakeholders Quality achieved; dissemination of information to commercial aquaculture stakeholders will be ongoing

Some iwi, regional councils and commercial stakeholders have been informed of the settlement via the aquaculture reform process, pre-commencement space consultation and attendance at hui.

The Ministry has prepared information to target iwi and runanga on the settlement and their rights and responsibilities. This information has not been sent out because a coordinated communication with the trustee is preferred, after the signing of the funding agreement, to ensure the different responsibilities of the Crown, the TOKMTL and regional councils are understood. This information release will be supported by other communication with regional councils,commercial aquaculture stakeholders groups and other MaOri newsletters.
