Application by Sanford Ltd to hold Patagonian toothfish quota in excess of aggregation limit

In December 2010 Sanford Ltd submitted an application to hold 80% of the quota shares for Patagonian toothfish. The aggregation limit for this species, as specified in section 59 of the Fisheries Act 1996, is 45%. Between 10 January and 3 February 2011 the Ministry of Fisheries, on behalf of the Minister, undertook consultation regarding Sanford’s request.

A briefing was provided to the Minister on 12 April 2011 and the Minister has made his decisions, which are contained in the attached decision letter

In summary the Minister declined Sanford Ltd’s request to hold 80% of the quota shares for Patagonian toothfish. However, he decided to grant consent for Sanford Ltd to hold 60% of the quota shares for Patagonian toothfish.
